Agreement to Terms

By accessing or using Sculpty ("the App"), operated by LumaScor LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old to use Sculpty. By creating an account, you represent that you meet this age requirement.

Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it.

You agree to provide accurate and complete information when creating your account.

You may not use another person's account without their permission.

User Content

You retain ownership of content you post on Sculpty, including Wall posts, notes, comments, and messages.

By posting content, you grant LumaScor LLC a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App for the purpose of operating and improving Sculpty.

You agree not to post content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

Connect & Messaging

Connect allows you to view other instructor profiles and send direct messages.

You agree to use messaging respectfully and for purposes related to the sculpt instructor community.

We reserve the right to remove users who engage in harassment, spam, or other harmful behavior.

Subscriptions & Payments

Sculpty offers a 30-day free trial. After the trial, access requires a paid subscription of $9.99/month or $79.99/year.

Subscriptions are processed through the Apple App Store. Payment terms are subject to Apple's terms and conditions.

You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.

Third-Party Services

Sculpty integrates with third-party services including iTunes (for song search and previews), Instagram, TikTok, and Spotify (for social profile links).

We are not responsible for the content, policies, or practices of these third-party services. Your use of linked services is subject to their respective terms.

Intellectual Property

The Sculpty name, logo, design, and all associated materials are the property of LumaScor LLC.

You may not copy, modify, or distribute any part of the App without our written permission.

Disclaimers

Sculpty is provided \"as is\" without warranties of any kind, express or implied.

We do not guarantee that the App will be available at all times, error-free, or meet your specific requirements.

Limitation of Liability

To the fullest extent permitted by law, LumaScor LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Sculpty.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
